Ryan Lochte is expected to be summoned to Brazil to testify in Rio de Janeiro as part of an ongoing investigation into his claims and he and three other U.S. Olympic swimmers were held at gunpoint during the Summer Games, according to a published report on Thursday.

Fox News reported, citing a police official, that prosecutors have requested him to testify in front of Brazil's Justice Department, although there is no penalty if he fails to appear. Lochte, however, would not be able to engage in plea negotiations unless he’s in Brazil.

"We have not heard anything about this (from Brazilian authorities)," Jeffrey Ostrow, Lochte’s attorney, told USA TODAY Sports.

No charges have been announced against Lochte and police are expected to conclude their investigation this week, the network reported. The result of the case --- including any charges --- would be funneled through U.S. federal authorities, leaving open the possibility that Brazil could ask Lochte to be extradited if charges are filed.

USA TODAY Sports investigation raises questions about Rio cops, Lochte incident

Lochte, 32, originally said that he and fellow American swimmers Jack Conger, Gunnar Bentz and Jimmy Feigen were pulled over while they were in a taxi by men with badges in the early morning hours of Aug. 14. Lochte said the swimmers were robbed, although he has since apologized and said his initial account was exaggerated.

Lochte returned to the U.S. on Aug. 17, the same day a judge ordered the four swimmers to remain in the country. Police alleged Lochte fabricated the story and guards at the gas station detained the four after Lochte vandalized a poster at the gas station.

The three other swimmers were questioned by police before they were allowed to leave Brazil.
